PTS Terms & Conditions
These Terms and Conditions (“Agreement”) govern your access to and use of the Personal Trading System (PTS) provided by Finsightful Wealth Pty Ltd (“Finsightful”, “we”, “us”, or “our”).

By completing the PTS onboarding process, you agree to be bound by these terms. If you do not agree, you may not proceed with PTS access.

1. Overview of the PTS System

The Personal Trading System (PTS) is a custom-built, educational trading tool designed to assist individuals in automating their cryptocurrency trading through user-configurable TradingView alerts and webhooks.

PTS includes:

Pre-configured indicator and alerts based on SMA, Gann Swing, volume, and momentum factors.
Automated trade execution via webhook (optional).
Fixed exit rules: profit target and trailing stop functionality.

You acknowledge that this system:

Requires active participation and configuration by the user.
Does not guarantee any specific performance or profit outcome.
Is not a financial product or advisory service.

2. Access Requirements

To gain access to the PTS indicator, you must:

Complete the PTS Course in full.
Pass a knowledge verification quiz.
Agree to these Terms & Conditions in full.
Submit your TradingView username and access request via the approved access form.

Finsightful reserves the right to deny, revoke, or suspend access if you fail to meet these requirements or breach these Terms.

3. Inclusions

Upon successful onboarding, you receive:

Access to the PTS Indicator in TradingView (for the duration of your Skool membership).
Access to the Finsightful Skool community and PTS course content.
Access to live onboarding calls, crypto market scans, and Q&A sessions.
Ongoing updates and system enhancements.

Note: Access to the system is conditional on maintaining an active membership with Finsightful Skool.

4. Legal Disclaimers

4.1 No Financial Advice

You acknowledge that:

Finsightful is an educational platform only.
All content, courses, tools, indicators, alerts, and messages are general in nature and do not constitute financial advice.
You are responsible for your own trading decisions and outcomes.

Finsightful is not licensed to provide financial advice under the Corporations Act 2001.

4.2 Risk Warning

Trading cryptocurrency and using automated systems involves risk. You may lose all or part of your capital. The performance of any past trading strategy is not indicative of future results.

You agree that:

You will not rely solely on the PTS for trading outcomes.
You will conduct your own due diligence and seek licensed financial advice where necessary.
You understand how to use TradingView, Bybit, and/or any third-party platform you choose to integrate.

Finsightful does not accept liability for losses incurred due to, but not limited to:

Misconfiguration of the system,
Exchange errors,
Market volatility,
Internet outages,
User error,
Any third-party platform outages.

4.3 User Responsibility

You are solely responsible for connecting your own TradingView, Bybit, or any platform integration.
You must enter all inputs accurately using the guidelines provided in the PTS course.
You acknowledge that incorrect use of the PTS may result in losses.

5. Subscription Terms

PTS access is included with an active Skool membership.
Cancellation of your Skool membership will automatically revoke PTS access.
No refunds are provided after access is granted unless required by law.

6. Support & Maintenance

Finsightful provides:

Technical support for onboarding and initial setup via community channels and live calls.
Troubleshooting support via Skool comments or email (within reason).

We reserve the right to modify, update, or retire components of the PTS system at our discretion.

7. Intellectual Property

The PTS system, scripts, training content, and indicators remain the sole intellectual property of Finsightful Wealth Pty Ltd.

You may not:

Share access,
Distribute code,
Resell,
Reverse engineer,
Or clone the PTS system.

Breach of this clause will result in immediate termination of access and possible legal action.

8. Termination

We reserve the right to:

Suspend or terminate your access if you breach these Terms,
Investigate suspicious behaviour or misuse of system access,
Enforce our rights under intellectual property law if you use the system outside of permitted scope.

9. Indemnity

You agree to indemnify and hold harmless Finsightful Wealth Pty Ltd, its employees, directors, and partners from all claims, liabilities, losses, and damages arising from your use or misuse of the PTS system.

10. Governing Law

This agreement is governed by the laws of New South Wales, Australia.
You submit to the exclusive jurisdiction of its courts.

11. Acknowledgement

By proceeding, you confirm that:

You have read and understood these Terms & Conditions.
You accept full responsibility for your trading decisions.
You release Finsightful from all liability for your use of the PTS system.

Eligibility Criteria for Refund:

You must have set up your TradingView account and executed strategies using the indicators provided.
A refund is only applicable if, after 90 days from the date of account setup, your net trading performance (as indicated by TradingView’s Strategy Backtest) is not profitable.
“Profitable” is defined as the net performance of all trading strategies executed on TradingView over 90 days being positive.

Important Conditions:

Performance of collateral assets or non-TradingView-tracked coins is not considered.
TradingView data must match the indicators provided upon sign-up.
Finsightful Wealth is not responsible for discrepancies between TradingView and Bybit’s performance.
Account setup date is defined as the date you became a Finsightful Skool member, verified via Stripe billing records.

How to Request a Refund:

Refund requests must be submitted in writing to hello@finsightful.au within 30 days after your 90-day performance review period ends (Refund Request Date). If a
refund request has not been provided by the Refund Request Date, the right to a refund automatically lapses and will be at an end.
You must provide TradingView Strategy Backtest reports demonstrating a net negative performance.
Refunds are processed within 14 business days, subject to verification.

Payment, Subscription & Cancellation Policy

Subscription fees for Skool or other programs are billed via Stripe and are non-refundable, except where covered under the 90-day money-back guarantee.
If you wish to cancel your subscription, you must do so before your next billing cycle via the Skool platform.
Chargebacks & Payment Disputes: If a chargeback or dispute is filed against your payment, your access to our services will be revoked immediately.

Privacy Policy & Data Protection

We respect your privacy. Personal information collected during sign-up (name, email, payment details) is used strictly for membership access and communication.
We do not sell or share your information with third parties.

Modifications to Terms & Conditions

We reserve the right to update or modify these Terms & Conditions at any time.
Any changes will be posted on this page, and continued use of our services constitutes acceptance of the revised terms.
